ONVIF Trivia Challenge

The ONVIF Trivia Challenge will take place on Twitter for four weeks from August 14 – September 11. For full contest entry rules, see below.

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING. These official rules apply to the Open Network Video Interface Forum (“ONVIF”) ONVIF Trivia Challenge (the “Campaign”). The Campaign is sponsored and administered by ONVIF. By entering, you are deemed to have read, accepted, and agreed to be bound by these official rules. This Campaign is in no way sponsored, endorsed, administered by, or associated with Twitter, Inc. (“Twitter”).

1.     Eligibility: Entry in the Campaign is only open to legal residents of the United States and only those other countries and jurisdictions that permit participation in online sweepstakes or contests and is void where prohibited by law – if participation is not permitted in your location then your entry may be voided. This Campaign is open only to those who are above 18 years of age at the date of entry. Employees and officers of ONVIF and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, and agents, and/or those living in the same household, are not eligible to participate in the Campaign.

2.     Agreement to Rules: By participating, the Contestant (“You”) agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept any decision of ONVIF as final and binding as it relates to the content of this Campaign.

3.     Campaign Period: Entries will be accepted online starting August 7, 2019, 12:00 am EST and ending September 4, 2019 11:59 pm EST. All online entries must be received by September 4, 2019 11:59 pm EST.

4.     How to Enter: To enter the Campaign, each week during the contest period tweet your response to the multiple choice questions posted on Twitter at [https://twitter.com/onvif] using the hashtag #ONVIFTriviaChallenge. The entry must fulfill all Campaign requirements, as specified herein, to be eligible to win a prize. Entries that do not adhere to the rules or specifications may be disqualified at the sole discretion of ONVIF. You may only submit one entry per week, but may Retweet the question of the week using the hashtag #ONVIFTriviaChallenge for one additional entry. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent these rules. If you use fraudulent methods or otherwise attempt to circumvent these rules, your submission may be removed from eligibility at the sole discretion of ONVIF. Entries are deemed to be received at the time of receipt by ONVIF, not at the time of transmission by an entrant. Alternate Method of Entry: Send an e-mail with the subject line #ONVIFTriviaChallenge AMOE to ONVIF@eclipsemediagroup.net, and be sure to include your preferred e-mail address for us to contact you if your entry is selected as a winner. You may submit one Alternate Method of Entry per week during the Campaign Period.

Restrictions on Entry Content

·     Entries must not contain material that violates or infringes another’s rights, including but not limited to privacy, ‎publicity or intellectual property rights, or that constitutes copyright infringement;‎

·     Entries must not disparage any person or party affiliated with the Campaign;‎

·     Entries must not contain material that is inappropriate, indecent, obscene, hateful, tortious, defamatory, ‎slanderous or libelous;‎

·     Entries must not contain material that promotes bigotry, racism, hatred or harm against any group or individual ‎or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and

·     Entries must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any ‎jurisdiction where the entry is created.‎

5.     Prizes: One will be awarded each week to an eligible entry for that week. A grand prize will be awarded to an eligible entry randomly selected from all eligible entries throughout the Campaign. There will only be one winner selected each week. Weekly prize winners will receive a $50 Visa Gift Card. The grand prize winner will receive a $300 Visa Gift Card.  Prizes must be accepted as awarded with no substitutions in cash or otherwise. ONVIF reserves the right to substitute a prize of equal or greater monetary value if a prize cannot be awarded as described for any reason. Winners will be solely responsible for any and all applicable federal, provincial, territorial, state and local taxes and any other costs, expenses and fees associated with accepting and receiving a prize. The prize is nontransferable. Winner agrees that Winner’s acceptance of a prize constitutes permission for ONVIF to use Winner’s name, likeness, and entry for purpose of advertising and trade without further compensation, unless prohibited by law.

6.     Odds: The odds of winning depend on the number of eligible entries received.

7.     Winner selection and Notification: Winners will be selected at random under the supervision of ONVIF. Each Winner will be notified via direct Twitter message within 7 days following selection of Winner, and will be required to supply an email address for receipt of prize. ONVIF is not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled entries, emails or tweets or for any incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Campaign or by any technical or human error or fraud, which may occur in the processing of the entries. ONVIF is not responsible for computer system, phone line, hardware, software, cable, satellite, Internet Service Provider (ISP) or program malfunctions, or other errors, failures or delays in computer transmissions or network connections. ONVIF is not responsible for any errors whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to, or in connection with, the Campaign including, without limitation, errors or difficulties which may occur in connection with the administration of the Campaign, the processing of Entries, views, postings and/or shares (as applicable), the announcement of the Prizes, or in any Contest-related materials. ONVIF reserves the right at its sole discretion, to disqualify any individual and void his or her Entry(ies) who tampers with the entry process. Receipt by Winner of the prize offered in this Campaign is conditioned upon compliance with any and all federal, state and local laws / regulations.

ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (at the sole discretion of ONVIF) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CAMPAIGN, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

8.     Rights Granted by You: By entering this Campaign, you agree to the collection and use of your personal information for the purposes of administrating this Contest and awarding the Prize(s). You further understand and agree that ONVIF, anyone acting on behalf of ONVIF, and ONVIF licensees, successors, and assigns, shall have the right, where permitted by law and to subject to ONVIF’s Privacy Policy where applicable, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, including without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Campaign, and biographical information for news, publicity, information, trade, advertising, public relations and promotional purposes without any further compensation, notice, review, or consent.

9.     Terms & Conditions: ONVIF reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Campaign should a virus, bug, non-authorized human intervention, fraud, or other cause beyond ONVIF’s control corrupt or affect the administration, security, fairness, or proper conduct of the Campaign, in such case, ONVIF may select the winner from all eligible entries received prior to and-or after (if appropriate) the action taken by ONVIF. ONVIF reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Campaign or website violates these Terms & Conditions. ONVIF has the right, in its sole discretion, to maintain the integrity of the Campaign, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Campaign rules; or the use of bots, macros, scripts or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine legitimate operation of the Campaign may be a violation of criminal and civil laws.

10.  Limitation of Liability and Release: By entering, You agree to release and hold harmless ONVIF and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether cause by negligence or not, from: (i) such entrant’s participation in the Campaign and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment, (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.

Any waiver of any obligation hereunder by ONVIF does not constitute a general waiver of any obligation to entrants. By submitting an entry, you agree that your entry is gratuitous and made without restriction and will not place ONVIF under any obligation, and ONVIF is free to disclose the ideas contained in the entry, on a non-confidential basis, to anyone, or otherwise use the ideas without any additional compensation to you. You acknowledge that, by acceptance of your entry, ONVIF does not waive any rights to use similar or related ideas previously known to ONVIF, or developed by its employees or contractors or obtained from other entrants or sources other than you. Released Parties do not guarantee the posting of any entry and may remove any entry at any time.

11.  Disputes: THIS Campaign IS GOVERNED BY THE LAWS OF THE USA WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Campaign, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Campaign, shall be resolved individually, without resort to any form of class action, exclusively before a court located in California having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waves all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Campaign.) Participant further waives all rights to have damages multiplied or increased.

3.     Purpose of processing: To use the data in accordance with the official Rules of the Campaign, including administrating the Contest and awarding the Prize(s). ONVIF may also use the data to publish news and information about the Campaign and for advertising and promotional purposes.

4.     Legal basis for processing: Agreement (the official rules of the Campaign).

5.     Categories of recipients: The data may be distributed to the public, in accordance with the official Rules of the Campaign. ONVIF may share personal data related to the Campaign with its licensees, successors, and assignees in accordance with the official Rules of the Campaign and subject to ONVIF’s Privacy Policy where applicable.

6.     Transfer to third countries: The data may be transferred to countries outside the EU, including the United States. In some cases, the United States may not be deemed to have data privacy laws that afford an equal level of protection for your personal information as those laws legislated at the direction of the European Union, however, please be assured that we will continue to adhere to the principles stated in our privacy policy (www.onvif.org/privacy-policy/) and in applicable laws in connection with any personal information. We will endeavor to preserve the integrity, confidentiality, and security of personal information and afford such personal information an adequate level of protection.

7.     Retention period: ONVIF will retain your personal data as long as the data are used for the purposes set out above.  

8.     Your rights: In accordance with applicable data protection legislation, you have a right to request access to or rectification of your personal data. Further, and to the extent set out in applicable data protection legislation, you may request erasure of personal data or restriction of the processing of your personal data. Under certain circumstances, you also have a right to object to processing as well as the right to data portability in accordance with applicable data protection legislation. Should you be dissatisfied with our processing of your personal data, you are entitled to lodge a complaint with the data protection authority in your country.
